Member Shang Wenjiang: Strengthening the Legal Protection of Intellectual Property Rights and Promoting Innovation Driven Development

"We need to continuously increase China's participation and voice in global intellectual property governance, attract technology innovation enterprises to invest and establish factories in China, and ensure the implementation of the innovation driven development strategy." Shang Wenjiang, a member of the National Committee of the Chinese People's Political Consultative Conference and Dean of the School of Business at China University of Political Science and Law, said in an interview with People's Daily.

Intellectual property is the source of innovation and development. The quantity and quality of intellectual property ownership are important indicators for measuring a country or region's technological innovation capability and economic competitiveness. According to the data of the China National Intellectual Property Administration, by the end of 2023, the number of invention patents in China (excluding Hong Kong, Macao and Taiwan) had reached 4015000, up 22.4% year on year, making China the first country in the world to have more than 4 million domestic effective invention patents.

Shang Wenjiang stated that as the person in charge of the appeal hearing mechanism for intellectual property cases at the national level, the Intellectual Property Court of the Supreme People's Court has been established for five years. Its types of cases it accepts resonate with China's technological innovation, market competition, and opening-up, actively helping to enhance the core competitiveness of the country and enterprises. However, at the same time, the operation of the Intellectual Property Court of the Supreme People's Court still faces issues such as insufficient protection of personnel, money, and supplies. Therefore, he suggested establishing a national level intellectual property specialized court to concentrate on handling intellectual property appeal cases involving strong professional and technical expertise nationwide, in order to better protect the legitimate rights and interests of innovators.

In addition, Shang Wenjiang has also given high attention to the development of cross-border e-commerce in China. He pointed out that with the booming development of digital trade, the proportion of cross-border e-commerce in cross-border trade of goods will continue to rise. However, the lag in the construction of cross-border logistics networks has become a bottleneck that restricts their rapid development. For this reason, he suggests increasing support for express delivery companies to expand overseas, optimizing global warehousing and express transportation systems, promoting the openness and application of smart logistics warehousing technology, and providing strong support for the prosperity of cross-border e-commerce.
